Terms of Service

These terms ("Terms") govern your use of Buvivo ("we", "us"), the website at buvivo.com, and any related services (together, the "Service"). By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

Buvivo is a marketplace that lets people looking for property in Spain ("customers") publish search requests and lets real- estate professionals ("agents") respond with matching properties. We are not a party to any transaction between customers and agents, we do not represent either side, and we make no warranty about the properties, offers, or conduct of third parties.

2. Accounts

You must be at least 18 years old to create an account. You are responsible for the accuracy of the information you provide, the security of your password, and all activity on your account. You must choose a role (customer or agent) during onboarding. We may suspend or terminate accounts that breach these Terms, provide false information, or misuse the Service.

3. Customer requests

Customers can publish one or more property search requests. Requests must describe a real search intent and accurate criteria. You may edit or close a request at any time. You are responsible for the content of your requests and the messages you send.

4. Agent contact unlocks

Agents access the feed of customer requests and can initiate contact by "unlocking" a request. Each unlock consumes one credit from the agent's quota and creates a direct messaging thread with the customer. Free-tier agents receive 20 unlocks on sign-up. Unlocks are non-refundable except where required by law; repeated unlocks against the same request do not consume additional credits.

5. Acceptable use

You must not:

  • Post false, misleading or fraudulent content.
  • Impersonate another person, business, or public figure, or misrepresent your affiliation with any party.
  • Use the Service to send spam, bulk messages, or unsolicited commercial communications unrelated to a legitimate property enquiry.
  • Harvest, scrape, or otherwise extract data from the Service for purposes outside its intended use.
  • Circumvent quota, rate-limit or access controls, including by creating multiple accounts.
  • Upload content that is unlawful, infringing, defamatory, obscene, discriminatory, or invasive of privacy.
  • Attempt to compromise the security of the Service or to reverse- engineer any part of it.

Breach of these rules may lead to immediate suspension or termination of your account without refund.

6. User content

You retain ownership of the content you post (requests, listings, photos, messages). You grant us a worldwide, non-exclusive, royalty- free licence to host, reproduce, adapt (for formatting purposes) and display your content solely as needed to operate the Service. You represent that you have the rights to all content you upload, including any photographs of property interiors or exteriors.

7. Third-party content

The Service may display content submitted by other users. We do not endorse and are not responsible for third-party content, offers, or properties. Always verify property details, ownership, and legal status independently before committing to any transaction.

8. Pricing, payment, refunds

The free tier is currently free of charge. We may introduce paid tiers in the future; any paid features will be priced transparently before purchase. Consumer rights under Spanish and EU law apply. Paid digital services may be exempt from the statutory 14-day withdrawal right under Article 103 of the Spanish Consumer Act (TRLGDCU) once performance has begun with the user's express consent; we will make this clear at the point of purchase.

9. Availability and changes

We aim for high availability but the Service is provided on an "as available" basis. We may add, modify or remove features, or discontinue the Service as a whole, with reasonable notice for material changes affecting existing users.

10. Limitation of liability

To the maximum extent permitted by law, Buvivo is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from your use of the Service. Our total aggregate liability for any claim arising from these Terms is limited to the amount you paid us in the 12 months preceding the event giving rise to the claim, or €100 if you paid nothing. Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under Spanish or EU law, including liability for gross negligence, wilful misconduct, or consumer rights.

11. Termination

You may close your account at any time from your profile settings. We may terminate or suspend your account for breach of these Terms. Provisions that by their nature should survive termination (including Sections 6, 7, 10 and 12) will survive.

12. Governing law and disputes

These Terms are governed by the laws of Spain. Any dispute arising from these Terms or your use of the Service will be submitted to the exclusive jurisdiction of the courts of Malaga, Spain, without prejudice to any mandatory consumer-protection rights that allow you to bring a claim in the courts of your country of residence. EU consumers can also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Changes to these Terms

We may amend these Terms to reflect changes to the Service or the law. For material changes we will notify registered users by email at least 15 days before the change takes effect. Continued use of the Service after the effective date constitutes acceptance of the new Terms.
